1. Acceptance of Terms
By accessing or using PhaseTwin ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Pilot Program Participation
PhaseTwin is currently operating as a limited pilot program. By participating, you acknowledge:
- The Service is in beta/pre-release testing phase
- Features may change, malfunction, or be discontinued without notice
- Your participation is voluntary and may be terminated at any time
- You agree to provide feedback and report bugs or issues
- The pilot is limited to a 4-week evaluation period with no obligation to continue

PhaseTwin is a wellness and fitness tool. IT IS NOT INTENDED TO PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.
Important:
- Always consult your physician or qualified healthcare provider before starting any new health, fitness, or training regimen
- Do not disregard professional medical advice or delay seeking it because of information from this Service
- This Service is not a substitute for professional medical care or emergency services
- If you are experiencing a medical emergency, call 911 immediately
- The Service does not diagnose, treat, prevent, or cure any physical, mental, or emotional condition
🤖 4. AI Assistant Disclaimer - Dr. Audri is Not a Real Doctor
Dr. Audri is an artificial intelligence chatbot powered by OpenAI. Dr. Audri is NOT a licensed medical professional, therapist, psychologist, or healthcare provider.
You acknowledge that:
- All responses from Dr. Audri are generated by artificial intelligence algorithms
- Dr. Audri cannot provide medical advice, diagnoses, or treatment recommendations
- Dr. Audri is for informational and educational purposes only
- You should not rely on Dr. Audri for health-related decisions
- AI responses may contain errors or inaccuracies
- Dr. Audri cannot assist with mental health crises, emergencies, or serious medical conditions
If you are experiencing a mental health emergency or suicidal thoughts, contact the 988 Suicide & Crisis Lifeline immediately.
5. Eligibility
You must be at least 18 years old to use PhaseTwin. If you are under 18, you may only use the Service with parental or guardian consent and supervision.
6. User Accounts & Data
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Providing accurate and truthful information
- Notifying us immediately of any unauthorized use
7. Intellectual Property
PhaseTwin and all related content, features, and functionality are owned by Adriana N. Tavarez and protected by copyright, trademark, and other intellectual property laws.
By providing feedback, suggestions, or ideas, you grant us unlimited rights to use, modify, and commercialize such feedback without compensation.
8. Prohibited Conduct
You agree NOT to:
- Use the Service for any illegal purpose
- Attempt to reverse engineer, decompile, or hack the Service
- Share your account credentials with others
- Use the Service to harass, abuse, or harm others
- Violate any applicable laws or regulations
- Use automated scripts or bots to access the Service
9. Disclaimers & Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.
We disclaim all warranties, express or implied, including:
- Warranties of merchantability, fitness for a particular purpose, and non-infringement
- That the Service will be uninterrupted, secure, or error-free
- That defects will be corrected
- That the Service is accurate, reliable, or complete
IN NO EVENT SHALL PHASETWIN OR ADRIANA N. TAVAREZ BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.
This includes damages for data loss, injury, loss of profits, or any other damages arising from use of the Service, even if we were advised of the possibility of such damages.
Maximum liability is limited to $0 (zero dollars) during the pilot phase.
10. Assumption of Risk
You acknowledge and assume all risks associated with:
- Physical activity and training based on Service recommendations
- Reliance on fitness and wellness data from the Service
- Beta software that may contain bugs, errors, or security vulnerabilities
- Potential data loss or corruption during the pilot phase
11. Privacy & Data Collection
Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect your data.
12. Termination
We reserve the right to:
- Terminate or suspend your access at any time, with or without cause
- Discontinue the Service or pilot program at any time
- Modify features or functionality without notice
You may terminate your account at any time by contacting us or deleting your account through the app.
13. Changes to Terms
We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.
14. Governing Law
These Terms are governed by the laws of the State of Massachusetts, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Hampshire County, Massachusetts.
